忘れんWatch利用規約Wasuren Watch Terms
1. サービスの性質・利用者責任
本サービスは利用者の判断と管理を補助するものであり、特定の結果、継続動作または目的適合性を保証しません。利用者は端末、OS、権限、通信、電池、設定および必要な代替手段を自ら管理し、本サービスだけに依存せず、自己の責任で利用します。
2. 禁止事項
違法・不正目的での利用、第三者の権利侵害、他人の端末・アカウント・電話番号・購入情報の無断利用、虚偽登録、認証または利用制限の回避、不正アクセス、解析、過大な負荷、妨害、無断再販売を禁止します。
3. 第三者サービス・変更・停止
本サービスはApple、OS、端末、通信事業者、APNs、Twilio、Firebaseその他の第三者サービスに依存します。運営者は、保守、障害、セキュリティ、法令、審査または第三者仕様の変更等の合理的理由により、本サービスを変更、中断または終了できます。
4. 保証・責任範囲
運営者は、検知、通知、送信、到達、時刻、正確性、完全性、保存、復元または継続利用を保証しません。運営者は、法令で許される範囲で、本サービスの利用または利用不能から生じる損害について責任を負いません。ただし、運営者の故意または重過失による損害、生命または身体に関する損害、その他強行法規により免責または制限できない責任には、この免責を適用しません。
5. 分離可能性
本規約の一部が無効または執行不能となっても、その部分を切り離し、残部は法令で許される範囲で有効に存続します。
6. 日本法・管轄
本規約は日本法に準拠し、本サービスに関する紛争は、法令で許される範囲で、大阪地方裁判所または大阪簡易裁判所を第一審の専属的合意管轄裁判所とします。
- iPhoneアプリとApple Watchアプリ間の専用Bluetooth Low Energy接続が切れたことを知らせます。Appleのペアリング、実距離、位置、盗難、紛失または安全状態を直接検知しません。
- 警報、通知、音、ハプティック、iPhone音声および背景動作は、OS、電池、消音、集中モード、強制終了、Bluetoothまたは通信障害等により遅延・不作動となる場合があります。
- 端末内では専用接続状態、警戒・通知・音設定、接続先識別情報および法務同意記録を処理します。追加通信を有効にした場合だけ、購入情報、確認済み電話番号、APNsトークン、切断・再接続時刻、事故ID、通話状態および最終接続時刻をサーバーで処理します。
- 未完了の番号確認情報は最大10分、回数制限用日時は最大24時間、終了した切断・通話履歴は最大12か月、App Store通知受領記録は最大24か月保存します。電話番号、最終接続時刻および通知端末は無効化または削除まで保持します。
- アプリ内の「サーバーデータを削除」から対象データを削除できます。購入・無料枠の不正再利用防止に必要な署名済み取引ID、HMAC化した購入者キー、契約期限、残数・失効台帳は、サービス提供中または法令上必要な期間保持します。
1. Service nature and user responsibility
The service supplements the user’s judgment and management and does not guarantee a particular result, continuous operation, or fitness for a purpose. Users manage their devices, operating systems, permissions, connectivity, battery, settings, and independent safeguards and use the service at their own responsibility without relying on it alone.
2. Prohibited conduct
Illegal or abusive use, infringement of third-party rights, unauthorized use of another person’s device, account, phone number, or purchase information, false registration, bypassing authentication or limits, unauthorized access, reverse engineering, excessive load, disruption, and unauthorized resale are prohibited.
3. Third parties, changes, and suspension
The service depends on Apple, operating systems, devices, carriers, APNs, Twilio, Firebase, and other third parties. The provider may change, suspend, or end the service for reasonable maintenance, failure, security, legal, review, or third-party reasons.
4. Warranty and liability
The provider does not guarantee detection, notification, transmission, delivery, timing, accuracy, completeness, storage, recovery, or continuous availability. To the extent permitted by law, the provider is not liable for damage arising from use of, or inability to use, the service. This exclusion does not apply to damage caused by the provider’s intentional or grossly negligent conduct, death or personal injury, or other liability that mandatory law does not permit to be excluded or limited.
5. Severability
If any part of these Terms is invalid or unenforceable, that part is severed and the remainder continues to the extent permitted by law.
6. Governing law and venue
Japanese law governs. Where legally permitted, the Osaka District Court or Osaka Summary Court is the agreed court of first instance.
- The app alerts users when its dedicated Bluetooth Low Energy connection between the iPhone and Apple Watch apps is lost. It does not directly detect Apple pairing, actual distance, location, theft, loss, or safety.
- Alerts, notifications, sound, haptics, iPhone audio, and background operation may be delayed or unavailable because of the operating system, battery, silent mode, Focus, force-quit, Bluetooth, or network failure.
- On device, the app processes dedicated connection state, guard, notification and sound settings, peer identifiers, and legal-consent records. Only after optional communications are enabled does the server process purchase information, a verified phone number, APNs token, disconnect and reconnect times, incident ID, call state, and last connection time.
- Pending number-verification data is retained up to 10 minutes, rate-limit times up to 24 hours, completed incident and call history up to 12 months, and App Store notification receipts up to 24 months. The phone number, last connection time, and notification device remain until disabled or deleted.
- Delete Server Data removes eligible server data. Signed transaction IDs, an HMAC-derived purchaser key, subscription expiry, and balance or revocation records needed to prevent purchase or free-allowance reuse remain while the service operates or as legally required.
